Swaziland
The country is party to the following conventions and agreements in the field of Intellectual Property, including; Paris Convention for the protection of Industrial Property, Patents Co-operation Treaty, Banjul Protocol for the registration of Marks, Harare Protocol on Patents and Industrial Designs, Madrid Agreement for the International Registration of Marks and the agreement of Trade Related Aspects of Intellectual Property Rights.
LEGAL INSTRUMENTS
While at the national level, its governed by Act 6 of 1981 and Act 72 of 1936, There are provisions for the registration of SERVICE MARKS and SERIES MARKS.
REQUIREMENTS FOR REGISTRATION OF:
TRADE MARKS
- The mark should be distinctive
- Application should be done through a trade mark agent
- Representation of the mark
- Mark should be in the relevant class in respect of goods/services
- Prescribed fees
PATENTS
- Proof of registration either in the Republic of South Africa or United Kingdom
- Prescribed fees
INDUSTRIAL DESIGNS
- Proof of registration either in the Republic of South Africa or United Kingdom
- Prescribed fees
Documents required:
New Applications
- Power of Attorney simply signed.
- Prints, except for word marks in ordinary type.
- Priority document (if applicable), with verified English translation.
Renewals
- Power of Attorney simply signed.
- Proof of use by way of a Statement accompanied by a specimen of the mark as used.
Assignments/Mergers
- Power of Attorney simply signed.
- Original or certified copy of Deed of Assignment or other instrument of title, with verified English translation.
Change of Name
- Power of Attorney simply signed.
- Certificate of Change of Name, with verified English translation.
Change of Address
Power of Attorney simply signed.
